If you are using the Site on behalf of an organization (such as an FBO or aviation business), you represent and warrant that you have the authority to bind that organization to these Terms.

3.1 Account Creation

To access certain features of the Site (such as submitting fuel prices or posting comments), you may need to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your login credentials confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

4.1 Fuel Price Submissions

When submitting fuel prices, you represent and warrant that:

• The information is accurate to the best of your knowledge
• You personally observed or obtained the price information
• You are not submitting false, misleading, or fraudulent information
• You understand that submitted prices are subject to moderation and verification

4.2 Comments and Reviews

When posting comments or reviews, you agree that your content:

• Is truthful and based on genuine experience
• Does not contain defamatory, abusive, or harassing content
• Does not infringe on any third party's rights
• Does not contain spam, advertising, or promotional material (unless authorized)
• Complies with all applicable laws and regulations

4.3 License to User Content

By submitting content to the Site, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content in connection with the Site and our services.

4.4 Content Moderation

We reserve the right to review, edit, or remove any user-generated content at our sole discretion. We are not obligated to monitor all content but may do so to ensure compliance with these Terms.

You agree NOT to use the Site to:

• Violate any applicable laws or regulations
• Submit false, misleading, or fraudulent information
• Impersonate any person or entity
• Interfere with or disrupt the Site's operation
• Attempt to gain unauthorized access to any systems or data
• Harvest or collect user information without consent
• Transmit viruses, malware, or other harmful code
• Use automated systems (bots, scrapers) without authorization
• Engage in any activity that could harm the Site or its users
• Post spam, advertisements, or promotional content without authorization
• Manipulate fuel prices or other data for competitive advantage

6.1 Subscription Overview

FBO operators may subscribe to claim and manage their listing on GA Airports. Subscriptions provide verified status, priority display, and the ability to directly update fuel prices and FBO information.

6.2 Pricing and Billing

• FBO subscriptions are billed annually at the rate displayed at the time of purchase
• Each airport location requires a separate subscription
• Payment is processed through Stripe, our third-party payment processor
• By subscribing, you agree to Stripe's terms of service
• Prices are subject to change; existing subscriptions will be honored until renewal

6.3 Subscription Benefits

Active FBO subscriptions include:

• Verified badge displayed with your fuel prices and listing
• Priority display of your data over other sources
• Dashboard access to update fuel prices and FBO information
• Custom profile with your FBO name, services, and contact information

6.4 Renewal and Cancellation

• Subscriptions automatically renew annually unless cancelled
• You may cancel your subscription at any time through your dashboard
• Cancellation takes effect at the end of the current billing period
• No prorated refunds are provided for early cancellation
• Upon expiration, your listing loses verified status but historical data remains

6.5 Refund Policy

• Refund requests must be made within 14 days of initial purchase
• Refunds are issued at our discretion and may be prorated
• Renewal charges are non-refundable

6.6 FBO Obligations

As a subscribed FBO, you agree to:

• Provide accurate and current fuel prices and service information
• Update prices promptly when they change
• Not misrepresent your services or availability
• Respond appropriately to pilot inquiries generated through the Site

7.1 Our Content

The Site and its original content (excluding user-generated content), features, and functionality are owned by GA Airports and are protected by international copyright, trademark, and other intellectual property laws.

7.2 FAA Data

Airport data sourced from the FAA National Airspace System Resources (NASR) is public domain information. Our presentation, organization, and enhancement of this data is proprietary.

7.3 Restrictions

You may not:

• Copy, modify, or distribute our proprietary content without permission
• Use our trademarks or branding without authorization
• Scrape or systematically download data from the Site
• Create derivative works based on our content or design

The Site may contain links to third-party websites or services (including FBO websites, restaurant information, and payment processing). These links are provided for convenience only.

• We do not control or endorse third-party content
• We are not responsible for the practices of third-party sites
• Your use of third-party services is at your own risk
• Review the terms and privacy policies of any third-party sites you visit

We expressly disclaim all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties of accuracy, completeness, or timeliness of information
• Warranties that the Site will be uninterrupted, secure, or error-free
• Warranties regarding user-generated content
• Warranties that fuel prices or other data are current or accurate

We do not warrant that any information obtained through the Site will meet your requirements or expectations. Any reliance on information from the Site is at your own risk.

This includes, without limitation, damages arising from:

• Reliance on fuel prices, airport information, or other data on the Site
• Flight planning decisions based on information from the Site
• Fuel purchases made based on displayed prices
• Inability to access the Site or any services
• User-generated content posted by other users
• Unauthorized access to your account or data
• Any errors, omissions, or inaccuracies in the content

In no event shall our total liability exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless GA Airports and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Site
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content
• Any misrepresentation made by you

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be posted on this page with an updated "Last Updated" date.

Your continued use of the Site after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
